現年60多歲的丁姓男子，經常到北市建國北路某家麥當勞用餐，而且總是點同樣的內容，久了該店的服務生都知道丁男的習慣，主動為他打理好餐點；然而今年4月間，丁姓男子上門點餐時，接待的女服務生卻沒有給他「熟客待遇」，氣得他怒罵對方，甚至動用餐廳主管前來調解。

根據了解，當時丁男不滿點餐被當成生客，竟情緒失控辱罵「像妳這種貨色…」女店員回說「你是什麼意思」，丁男卻嗆「麥當勞分很多等級」、「你不要做好了！」而爆發爭吵。最後，女店員不滿自己只是幫忙點餐卻被羞辱，決定控告丁男妨害名譽。

出庭時女店員指出，店內規定點餐必須以固定流程詢問客人，否則會被記缺失，不了解丁男為何如此生氣。丁男則辯稱，自己並未辱罵，也沒有提到「貨色」二字；他常到那間麥當勞用餐，店員都知道他會吃啥，唯獨這個服務生不知道，反過來批評她的服務態度。

檢方根據目擊者和麥當勞主管的證詞判定，丁男確實有說出「像妳這種貨色」等詞句，其中「貨色」已經有物化貶低之意，加上丁男並未與對方和解，仍依照公然侮辱罪起訴丁男。
